At its meeting of February 23, 1987, the Board of Directors of Writers Guild of America, West, Inc., adopted the following statements of Strike and Unfair Lists policy:
STRIKE LIST: The Board of Directors may place individuals or companies on the Strike List for failing or refusing to engage in collective bargaining negotiations with the WGA, for failing or refusing to sign the MBA or other applicable collective bargaining agreements, for wrongfully failing to participate in grievance and arbitration procedures, for failing or refusing to abide by the final award of an arbitrator for any reason whatsoever, or for engaging in conduct violative of the National Labor Relations Act or other laws designed to protect the rights of writers and other employees.
UNFAIR LIST: The Board of Directors may place individuals or companies on the Unfair List in the event that the Board determines that a particular individual or company is not reliable or financially responsible whether or not such individual or company is signatory to a collective bargaining agreement with the WGA.
GENERAL: The Board of Directors will consider requests from individuals or companies to be removed from the Strike or Unfair Lists. In such cases, the Board will examine, among other factors, the facts and circumstances concerning the strike or unfair listing and the reasons advanced for removal.
NOTE: Working Rule #8 (“No member shall accept employment with, nor option or sell literary material to, any person, firm or corporation who is not signatory to the applicable MBA.”) relates to the Strike List. Working Rule #10 (“No member may enter into a contract for the rendition of writing services with any producer whose name is contained in the then current Guild Unfair List unless such producer shall have first posted a bond with the Guild guaranteeing the full amount of the writer's proposed compensation pursuant to such contract.”) relates to the Unfair List.
